The Penal Code (Amendment) Act 2025 has been gazetted and entered into force, among the highlights are:

1. Harassment and distress – Using threatening, abusive, or insulting words, communication, or acts with intent (or likelihood) to cause harassment, distress, fear, or alarm is an offence punishable by fines or imprisonment of up to three years.

2. Causing fear of harm – Acts or communications causing harm to a person or provoking self-harm, are criminal offences with penalties of up to ten years’ imprisonment in severe cases.

3. Misuse of Identity Information – Publishing or circulating personal identity information with intent (or likelihood) to cause harassment, fear, or harm is prohibited, with penalties of up to three years’ imprisonment.

Members are advised to take note of these amendments, especially in relation to business communication, customer data management, and workplace interaction. Please ensure that all company practices comply with the new legal requirement to avoid legal exposure.

Postponement of engine oil label enforcement

Dear EMPTA Members,

Please be informed that the Ministry of Domestic Trade and Costs of Living (KPDN) has announced to postpone the enforcement of Trade Descriptions (Certification and Marking of Engine Oil for Motor Vehicle) Order, which took effect from 7 April 2025.

KPDN is postponing the enforcement until 7 October 2025 following feedback from industry associations and industry players. The consideration by KPDN to allow more time for industry players to comply with the new regulation is highly appreciated.

Together with other related industry associations, EMPTA is committed to work with KPDN in compliance with the new regulation and fight against counterfeit engine oil products.

INDUSTRY UPDATE: WORKING TOGETHER FOR A SOLUTION

Selangor and Federal Territory Engineering and Motor Parts Traders’ Association (EMPTA)

EMPTA, together with other automotive industry associations have submitted a petition to the authorities to highlight the issues confronting members pertaining to Trade Descriptions (Certification and Marking of Engine Oil for Motor Vehicle) Order 2024, such as certification requirements and unsold stocks after the Order’s effective date 7 April 2025.

Following that, EMPTA committee members had a discussion with the authorities yesterday. The Ministry of Domestic Trade and Costs of Living (KPDN) verbally agreed on the following:

1. Consider to postpone the enforcement of the new regulation.

2. Assist industry players to overcome the challenges in compliance with the new regulation.

3. Meet representatives of EMPTA and other associations for further discussion on all related matters.

ENGINE OIL CERTIFICATION AND MARKING

Please be informed that the Minister of Domestic Trade and Cost of Living has issued the Trade Descriptions (Certification and Marking of Engine Oil for Motor Vehicle) Order 2024 that will come into effect on 7 April 2025. Among the highlights of the new regulation are

1. Suppliers of engine oil for motor vehicles must apply to SIRIM QAS International Sdn Bhd to obtain certification and conformity label for the engine oil.

2. The engine oil for motor vehicle shall be marked with conformity label issued by SIRIM QAS International Sdn Bhd.

3. Failing to comply with the new regulation face penalty of up to RM200,000 (for company) or RM100,000 and 3 years of imprisonment (for individuals).

The new regulation may have significant implications for businesses in our industry, and we understand that many members have concerns regarding compliance, operational adjustments, and the potential impact on business.

Please be assured that EMPTA is actively working on this issue. We recognize the need for greater clarity and practical solutions, and we are in the process of arranging a dialogue with Ministry of Domestic Trade and Cost of Living (KPDN). This session will allow us to present industry concerns, seek further explanations, and advocate for fair and workable implementation measures that do not unduly burden businesses.

EMPTA committee will keep members updated on the outcome of our engagement with KPDN.
